My Father was working in a Insurance Company. He was terminated illegally in 1991. That time my father filed case in court to return his job. The court ordered the company to return his job & paid his due salaries. But the company filed case in the high court in 1995 against the judgement. High court also gave the same judgment for my father. Then they appeal to the supreme court. But the chief justice finally dismissed the case ordering to send down to the lower court (district judge) to settle down the amount within 3 month in 2004. But after 3 years in district court it will be hearing 28th Oct, 07. But my father last week had fallen in brain stock (Now senseless). Please advice how we will proceed the hearing as his sons.

This fact about your father's mental condition cannot be kept hidden from the court & hence you have to produce in the court all the medical reports concerning his health condition. You as a son has to take permission of the court to be added as a legal representative of your father as far the getting his due salaries are concerned. Since his mental condition is such that he cannot be taken back on job as ordered by the court, but his salaries upto the period he was fit enough to take the job back & other financial benefits that he would have got as a employee of the company including the medical facilities & benefits should be allowed. All such issues should be pleaded before the court by your lawyer & you be allowed to get all the financial benefits whatever the court allows on his behalf.

You need to secure a lawyer to represent your father in court. This is too important not to hire a lawyer for. Sounds like the company wants to really avoid having to pay your dad his dues. It must be significant. Therefore, you can't fight them without legal assistance. You don't want to lose out on anything you have coming. The judge is not gonna help you in court. He/she will only be neutral to both sides. You need a competent lawyer on your side.
