I have mold from a prev leak and it keeps coming back and now recieved a letter on my door from the apartment complex that we have asbestos, this will be my second attempt in writing a letter of the unhabitable living conditons. I live in GA any advise?

I would ask the management if they can completely rid of your mold issue and also ask them if they plan on doing anything about the asbestos. If they give some excuse saying they're trying to work on it, just explain to them that you find it uninhabitable to live in, and that you've tried talking to them about it before. Give them another month to actually do something about it, if they don't then contact the Department of Health, see what they say, and if they say it would be okay to break your lease, tell management at your complex that you've spoken with the DOH and give a two week notice. In the meantime, start looking for another place to live, just in case! Good luck, and I hope you get this resolved!

The fact that the structure has asbestos in it does not make it uninhabitable. Asbestos comes in many forms in structures. As long as it is in 'encapsulated form', it does not present any hazard to occupants. Asbestos, in the past, was used in vinyl inlaid flooring, as an example. As long as that flooring remains undisturbed, there is no health hazard involved. Same goes for siding containing asbestos.

As far as the mold issue goes, mold spores will not thrive and survive in the absence of moisture. Do what you can to control and lower the levels of moisture in your living unit. No matter what the landlord does to remove molds, they will return if you do not control moisture levels. Mold spores are everywhere in the atmosphere, and they only cause issues when they find a moist area in which to settle and reproduce.

In short, part of mold control is YOUR responsibility. If you do not keep moisture levels at a lower level, they will continue to return, no matter WHAT your landlord does.

Call the city inspectors to come over and take pics and samples, they will give a notice to your landlord. Ask for a copy of the report and there you go if it really is unsafe you should have your hotel paid for until you can find a suitable residence
