I cannot afford a lawyer, and legal aid does not "do" civil law or personal injury cases/law suites. I am a Canadian.
I was served the law suite 3 days ago and have 17 days to prepare a defence (according to the law suite guidelines).
In Short: I was in a car accident Jan.2006. It is debatable to whom was at fault. My opinion is we were both at fault. We both were taken to the hospital. She "t-boned" me. Anyway, the police investigated, took a report. At the accident site she acted hysterical and the officer said he didn't understand why she was overreacting so much. He also told me that she was in a car accident just 3 weeks prior. Now she is trying to blame me for her injuries, when it is very possible that this could've started in her previous crash. Both her cars were write-offs. My insurance lapsed.
This is a very brief version of what took place.
Besides handing in my letter of "intent to defend". What do I need and how do I go about it, in order to defend myself?

First of all, reaserch the report that said she was in a wreck prior to the wreck, and if she was injured it should be down on the report. Also do you have witness, if you do and you did not do it, you can charge her with filing a fradulant law suit on you, and that can rake in the cash. Were you injured, if you were couter-sue her with the same charges, most likely, i am not going to say it will happen, but she will probably back down, and if she is not in sound mind it really isnt a case. Remember never back down and pray to god for help, and also if you cant afford a lawyer ask your parents, family memebers, or even really good friends for help, everyone should support you this a very harsh insinuation she is putting on you. Also if you dont mind, email me weekly with what is going on and i can give you further advice on what to do after you make ot to court, also ask the judge if she is willing to settle out of court. Get a copy of the police report, hopefully it will be in your favor, see if you can get some kind of proof about her previous accidents. Off the top of my head and without seeing any photos, I would say if she T Boned you, then most likely she was at fault because she should have had enough time to avoid a collision, either by braking or maneuvering around you, sounds like she wasn't paying attention. Also, see if it is not to late to file a counter suite against her for your damages. (court clerk office) If you need more time ask the clerk if you can file for a continuance, if not, ask the Judge when you get to court. Just present your case with the truth from your point of view.. Don't lie because if you get caught in one lie, no one will believe anything else you say. Good Luck my Friend

Basically -- you are asking for people to tell you in several paragraphs -- how to fight a war against someone who has trained for years in that profession.

The short overview -- you will need to defend yourself both procedurally and based on the facts -- both are very different in terms of what is required and how to do it.

Procedurally -- you need to answer their complaint -- deny the allegations that you think are false -- and assert what are called "affirmative defesnes" -- reasons why even if what they say is true, you should not be held responsible. For example -- even if there was an accident, they were also at fault -- that's one simple example of an affirmative defense.

After that -- expect the other side's attorney to play procedural games -- using the tactical advantage of someone who knows the courtroom battlefield to make it difficult for you to compete. There is no simple way to prepare for that kind of warfare -- you just need to read everything they send you and try to follow the rules as much as possible.

The factual issues only come up later -- when you are trying to prove during trial what really happened -- but before that point, you'll need to deal with the procedural warfare.

As a "Small" girl living in a big "Mans" world I looked at other answers first and found them to be so true in what others consider as "Pass it off, it will go way" Gee this was not grocery market, tabloid trash to be read in the checkout line. Why would she embellish, and in this era investigators can revover things thought to be destryed or erased. I'm glad I'm a gay female, and while I don't want or need to engage in a war I think the global metality tries to disregard how woman are disregarded. That sounds like the middle ages or a culturally based feeling. Woman perhaps may be somewhat to blame, but not by intent. Hitlers mom might be a striking example of what went wrong, that she never considered. I detest the waste of time news, and views as so much is so tainted, skewed, biased, and supported by advertisers and ratings pressure. There are no easy fixes, but there needs to be a sense, of, "Guy, put yourself in a skirt for a day, or more for a night, be public, and ward off any who may want to attack, protected by an inane constitution in perversion and corruption." As D might say, "Bullets are cheap, lock and load, and let God sort it out later" Pardon me while I vomit.

cite her questionable character and prior history, and mention your clean driving record
