NYU is REALLY hard to get into, even if you're in-state. Raising your grades will help, but if you can't get a pretty high GPA, it will still be difficult to get in. It's not that they won't think you're smart enough; it's that they need students who will apply themselves, and they assume a poor GPA means a lack of initiative.

Go ahead and apply to NYU. If you don't get in, consider taking a year or two at another college or community college, then trying to transfer in.

What year of high school?

If you freshman, then your okay, just get high marks for the rest of the 3 years

If you are in junior/senior year, your kinda screwed, mybe go community college and transfer?
