My husband who is 54 and on permanent disability from a failing heart has recently been notified that his disability checks are to be garnished. He makes a mere $851.00 per month and they are taking just under 11% at an even $100.00! This made us just sick. With all the changes, adjustments and health scares weve both endured, now this!
The child is now 33 years old. It is not as if my husband missed paying child support on a regular basis, quite the contrary-I was there to see him pay monthly, missing very little. WHat was originally ordered by the court from birth to age 18 would have amounted to 22,000. He has payed on this child for thirty years AT LEAST and the state still sends him statements with figures that frequently change but are always over 30,000! How does this stuff happen! I know we need to consult an attorney.

Perhaps he misunderstood the original order or the order was modified.

By the way, $22,000 over 18 years is just under $102 a month. Unless your husband has been making minimum wage for the last 33 years I suspect his support obligation was higher. In 1990 I was in the Navy and had two children. I made very little money and my support order was almost $700 a month.

Yea you should definately see an attorney. Most states have no low that they will stop at when it comes to child support they will garnish anything. You may have had to get a court order to stop payments when the child turned 18. State social services wont do this for ya, they will just keep taking your money. Definately have an attorney look into it. As the state will make no effort to see your husband treated fairly and within the law.

Think of it this way. If his child was living with him, he'd have to feed and clothe the kid. The fact that someone else (the mother, the taxpayers, or both) paid the freight for the kid's support...does not extinguish his debt. Interest racks up too, doesn't it?

If you are concerned about what you and your husband will have to live on, I invite you to think about the concerns that your stepson's caregiver must have had, making ends meet. Must have been stressful, without your husband's consistent help.

I know it was stressful for me and my mom when MY dad didn't pay as required. Bummer when the shoe is on the other foot, eh?

because the state originally paid the child support and your husband paid the state. well when you miss paying child support the state still pays then charges interest and collection fees. also your husband must not have been paying the state he owed as 30 grand is a lot to owe.

definite, disability repayment funds would nicely be garnished for alimony and newborn help funds if allowed by state regulation, and the legal procedure is served in accordance to state regulation.
