A child can choose where they live once they are no longer a child. The court decides who should have custody.

If New Jersey is like most other states, there is no set age (before emancipation at 18) for this determination. A court deciding custodial issues will take a number of factors (including the child's wishes) into account when ruling on where the child should live. Depending on the child's age, the court will assign the appropriate amount of weight to those wishes. Usually, the older the child, the more likely a court is to pay attention to his or her wishes.

The court must respect the best interest of the child, and that doesn't mean the kid gets to choose.

Maybe if you are going ot upgrade your boyfriend, you also need to upgrade your attorney - your ex certainly has upgraded his :)
