I live in TN, I have 2 children with my soon-to-be ex-husband. I have seen a divorce attorney and all the papers have been signed, including the child support worksheet which showed what he was obligated to pay each month. I cannot go to court until I pay my lawyer the remaining $250 that I owe him, and as I haven't gotten any child support to date, I can't pay the attorney (I'm WAY behind on all my other bills)... My question is this: Even though I have a divorce lawyer who is also supposed to get me child support, can I go through human services or the DA's office and get child support that way instead of waiting?

I did talk to my attorney about filing a motion to set child support without finalizing the divorce, without me having to pay him the rest of what I owe. I've already given him $400, and nothing has happened. He said he would file the motion but that was 2 months ago and I have yet to hear anything.

Dear Explorer: You know nothing about it. Share the support equally? I work 40+ hours a week to take care of my children, I don't party, I don't spend anything on myself because THERE'S NOTHING LEFT AFTER BILLS AND WHAT MY KIDS NEED. My ex has never lifted a finger to help, financially or otherwise. He rarely ever gets them on his weekends, never calls to check on them, forgets their birthdays. I don't give two S*hits about the almighty dollar, except for when I'm about to lose everything I have because there's not enough money to go around. We bought all this stuff together (house, car) and he WALKED OUT AND LEFT ME WITH IT. I'm not asking him for alimony, I'm only asking him to take up his part of the responsibility. So get off my back!

I went to the DA child enforcement part. They did it all. Then i got divorced. they take it straight out of his check because he refused to pay. So yes, you can goto the DA.

Call the Attorney General's office they set up a case for you and the child support. They are kind of like the middle person. He would pay the child support to them and they send you a check every month. If they don't receive the money then they keep that recorded so if he gets to far behind in child support then he could go to jail.....he should be just giving you money even without being obligated to by the courts...those are his children too

The lawyer is waiting to be paid in order for him to file the support order. Without the support order being filed, no order of support by the court will be ordered for you to receive payment. Until this order is filed, it still does not exist according to the court. You also need to hurry, as the court will kick the motion out if you do not act on it within a given length of time. Then you will be out the $400 and no filing for support and will have to repeat the process.

I'm not sure about most of your question but I can tell you this from personal experience.
Your ex doesn't have to start paying until he is ordered to do so by the court. The payments will start then and he will not owe anything from before that point.

since you have an attorney they probably won't; you should contact them. i know when I worked for an attorney we could not see a client if they already had counsel.
The attorney won't work with you on the remaining $250? that is so sad. you're trying to make things better and just need a little boost. wish i could help.

Here in Pennsylvania you don't need an attorney to go for child support. You just go to the Domestic Relations office in the county you live in and they set everything up.

People like you are what makes me sick, You are looking for a freebie an additional income, it just sucks! Dont worry the guy will get screwed because you'll probably have a big sob story and the DHR will buy that BS. You child is deserving of support but making it all so important to have that dollar without the father is just wrong. Share the support equally thats fair and show what your using is for the child and not for your fun

You can try the d.a. but try this OCSE look it up on the internet. i have a child support issues too. these people are pretty good and you don't have to pay them anything. they will make sure you get your money. type in OCSE Tennessee and also if you need $$ if i were you and if you are not working go to social services. email me direct okay. ;)
