What kind of evidence(s) does the court look for, if it is required? It is not like physical abuse where evidence is evident.

There is always the grounds of irreconcilable differences for divorce, even if you were unable to prove physical or emotional abuse. However, much of divorce court is he said/she said, so you just have to try to keep good records of any goings on between you and your husband, especially if he leaves a message on the phone or an email. Which would definitely constitute PHYSICAL EVIDENCE! Also, you should make sure that any and all of your own actions from this point on are above reproach, so that he has nothing to attempt to use against you! Good luck.

It's never good to try to make the other person the reason for the divorce. The judge will think you are being petty. Real divorces are about finances, assets, custody and visitation. Cite irreconcilable differences as the reason. If you are concerned about the children being abused this way, I would suggest contacting Child Protective Services in your area. Also take the children to a mental health professional with your concerns. They may be able to give you documentation for the judge so you can ask for limited custody/visitation some parenting and anger management classes for the other party.

YES! It depends on what state you are from. In Florida for example, we are a no fault state so no evidence is required.

yes it is a reason for divorce. but i don't know what the court would look for. don't get married next time.
