My husband backed into a friend's car in June. She said "not to worry about it and that she didn't even care about her car". Now, almost 5 months later....we got a call telling us we have to pay $618 to fix the damage. Not only does this suck coming from our friend, but 5 months later? Is this legal?

Nothing was reported. It was simply a "its not a big deal" and they both drove away situation.

Did you file a police report for the accident?

Now that's just crappy,
It isn't enough for the insurance to deal with, You can drag it out or make small payments.
Remind her in a letter stating that since she at first rejected any claim to the damage, but out of good faith and being co-workers you will pay her back at the rated of 50 bucks a month, as she did not allow you to review any of the estimates for repair.

If she has issues with that tell her see ya in court, She'll take it. This is a nice way to be as crappy to her yet fulfill your legal obligation.

Or just say HuH! what accident I didn't back into you. What date time witnesses, Sorry you must be mistaken...

OH YA! hey on the estimate make sure she gives you the written receipt of the work done that way you know if you paid for the damage or maybe she had a little something else taken care of also and said hey they'll pay for it. A judge will go with the obvious as I bet you would admit in court that you hit her but she would say she never agreed to "don't worry about it". Nice people are everywhere.

In most states people have two years to press a claim for damages.

Comeon now...
Police report or not.. if you hit her you owe her the repair no matter how long she takes, but 5 months is nothing.

Check her estimate.. make sure you are paying for what you broke.. and write her a check.. friendship is nothing to lose over something that was your (well.. your husbands really) fault in the first place.

Laws differ from state to state. With no police report your insurance may not pay. Did you ask her why she is just now telling you to pay this money? Its seems too far after the fact, but if she can prove you damaged her car she probably could take you to small claims court to collect.
