I live in an apartment townhome community in Richmond City, VA. There have been a string of breakins all summer and yesterday the apartment next to mine had the door kicked down and the robber tried to rip the alarm out the wall. I am getting scared to live there period. Can you break your lease if you are afraid to live there, my current lease is up in January. Thanks for all responses.

No. Fear of living in a residential unit is not a legitimate excuse to break a valid lease. Chances are strong that you will pay penalties and rents if you attempt to terminate your lease early.

You have but a couple of months until your lease expires. Tough it out, and start looking for different premises. Then give appropriate notice that you will not be renewing and prepare to move.

No. You would have to proove that the landlord was violating some building code to have any grounds. Your city will have an inspector's office and someone else who can tell you the rules over the phone. This can give you leverage with the landlord if you think they will be very difficult. In some cities, it is a violation to leave large cracked windows for more than a certain period of time. Look up the codes in your city.
Your best bet is to discuss an early lease termination with the landlord. Sometimes they will work it out with you so that you do not need to pay the full balance and penalties. You also can try to sublet to someone without your fears.

This is a tight rope.....to prove, but......
if the landlord has done nothing to repair, or improve security conditions around the property, and is aware of the many break-ins........if the people breaking in are friends of somebody living there, and using their place to check out tenants habits, or they live there themselves, and does nothing about it, then........this stuff all takes time though, and since your moving in Jan. just try and make it look like somebody is there all the time, Tv an lights on..........

You would not be able to break your lease legally without paying for it. You could always try to talk to your landlord and see what happens.

Pull out your lease and read it. It will spell out what conditions would allow you to do so.
