Me and My Boyfriend are getting Married in Mexico and of course he is Mexican! And I was also wanting to have My baby their! But I was wondering if I have My Baby their, would My Baby still be considered a citizen of the US? And if Not what would I have to do to make My Baby legal to be able to bring Her back? I know this sounds kinda stupid! But My friends mother told me My Baby would be legal if born in Mexico since I am American! But I dont see how My Baby would be considered an citezin of the US if a Mexican who is born in Mexico comes here and is illegal! Sorry if that doesnt make since but I need help!

If your baby is not born on US soil -- then the child does not get the automatic birthright citizenship guaranteed by the 14th Amendment.

However -- if you are a US citizen -- you can petition to have you child declared a US citizen as well -- regardless of where the child is born -- the process is just different.

A child born to an American citizen DOES get automatic citizenship regardless of place of birth. A child born on U.S. soil, including Embassies etc. is a citizen regardless of parents nationality.
A Mexican born in Mexico who comes here illegally is an illegal. That part should be easy enough to understand.

If you are an American citizen, then your child would automatically be an American citizen no matter where it's born.

I found an interesting link on this subject. Basically, if one of the baby's parents is a US citizen, then the baby is granted "citizenship by birth" as soon as it returns to the US as long as it is returning as a permanent resident.

If the child lives abroad with the citizen parent or grandparent and only returns to the US temporarily, it will become a naturalized citizen - meaning it can't ever run for the office of President or Vice-President.

Holy crap learn to use spell check. Your baby will have to choose his citizenship when he turns 18. untill then becuase you are an American your baby will be considered an American no matter where he is born.

i was thinking that as long as the mother is a citizen, the baby is a citizen....kinda given the same rights as the mother i guess

if the baby is born out of the US then it is not a US citizen, unless it is born at a US military base or US embassy.

You shouldn't be travelling if you're that late in your pregnancy.
