So, I recently got a job at Cinemark. They hired me, and I was doing orientation. Near the end of orientation, they found out I'm 15. So basically I got fired for not being 16. The age limit for minors to work in my state is 14. I was not aware of Cinemark's company policy to not hire below 16. This policy was not brought to my attention, nor was it on the application. I did not lie at anytime during the hiring process. It was there fault for not calculating my age from the birthday I provided them. Plus I'm not being paid for the hours I did for orientation. Is there anything I can do about this?

The difference between this and discriminating on age, is that I was hired, and only the fact I was one year younger than COMPANY POLICY is what led to my dismissal. The only reason I was fired was age, not my qualifications for the job.

If others got paid for orientation, you should be, too.

If their policy is not to employ under 16, there is nothing you can do about the job.

If others got paid for orientation, your state has a state labor board. Call them. They are there to protect your rights.

Sorry CJ, but its company policy. They don't hire people under 16 for a reason. Yes, you are entitled to payment for the time you spent in orientation. However, you might be better off letting it go if you hope to get hired by them when you do turn 16.

you should get paid for the orientation. you need to go to your parents and tell them. i personally would just hand you the money and call it a day with these fools. but, back in the back of my mind i would also (as a mom) want to get a lawyer for my daughter and have him send them a note. scare the poop out of them then they would send you the money. you earned that money in my mind. you didnt lie. they were the carless ones in their hiring process. you may not get this job but you will get paid. or if your parents dont want to hire a lawyer you need to report this to the attorney general in your state. now until you are legal age employers will try to mess with your hours and everything. you need to keep track of the hours your worked on what day no matter what job you got. get a little calender to mark this stuff down including overtime. once you are over 44 its hard for you to get fired becouse you are too old.

I think they are required to pay you for what little time you were there for orientation but yeah they can set an age requirement tougher than the state. They can make there age requirements hire but not lower.

In the US, it is illegal to discriminate on the basis of age for employment only for employees over 40. For employees under 40, age discrimination is legal.

I they didn't tell you that policy when they hired you and didn't realize how young you were, then they should pay you. If they don't report them to whatever government organization oversees wage & hours disputes in your state. They can't work you and not pay you and if they pay others for orientation, then it seems to me they owe you.
