The bottom line is, the companies need the fans to buy their products, and if the US companies go out of business, it means THE END OF ALL ANIME, because the Japanese companies need licensing fees from US companies in order to stay in business. You won't be able to get everything you want from fansubs because there won't be any new anime to fansub.

It doesn't matter. The only thing that would happen would be an increase in the crackdown on people who own sites based in the US. If that happens, sites will just migrate to other countires that don't seem to care as much. Anime will still be shared.
Personally I am just waiting for when television embraces the internet world, and then this stuff won't be illegal at all. When bandwidth become almost a non-issue, you'll see television shows (with ads) that you can access at anytime distributed by the networks. Heck you already see this with sites like NBC. I'm that like in a decade we see anime with subs on legit streaming sites coming out regularly a week after they air in Japan.
That way, we still get anime fast and good quality, and the Japanese companies still make money.
Edit: No, it wouldn't become a paysite. They'd have an advertisements play before the video airs to pay for everything. That's how I watched Heroes. I saw the entire first season online, streaming (in a much higher quality than youtube and veoh), for free, and all perfectly legit. I can sacrifice 2 minutes out of my life if I can watch those episodes whenever I want. Besides, I would be waiting for at least 2 minutes anyways (if I'm lucky) for episodes of that quality to download in the first place.
