Kick them out. Legally, they might have 30 days notice. But if they are living with you, through them out and give them two days.

I know of a situation were this lady let someone stay with her until they found a job. They were not paying rent and staying out all night partying. She did not know how to resolve the situation.
Someone told her to invite one of your relative to come and stay for a month. She informed the free loader that an out of state relative was coming to stay until the relative found a job. The free loader would have to sleep in the living room and give up the bedroom.
The free loader was gone within a week, and the nice lady had her place and changed all of the locks.

I assume its the same in all states. But a verbal agreement is the same as written for tenants rights. You should have put it in writing.
Most states if they dont pay you, you can file a motion for eviciton. They have 3 days or the police show up. If they are making their payments, you cant really do much.
If they are late, evict them. If they catch up their payments you will have to prove you didnt have an agreement. They show up in court with 3 payments from their checking account. You will have to prove why they shouldnt be there. And prove they never had a contract. You better hope they never gave you 1 penny. If they did im my opinion you are screwed without an agreement.
Evict them. They didnt pay rent. If they fight it, you are screwed, without an agreement.

The legal name for this is call "tenancy in sufferance."Even if you did have a lease you need to go about the right way about this or could possibly be sued.The first thing you need to do is go to the clerk of the county court & get an eviction notice giving the respective tenant 3 day to pays the rent or leave.from there;if they refuse to leave,you must go to the clerk again & file a complaint & have a sherrif deliver a notice to them.This can take anywhere from a week to six months depending on the state & county you live in.To be absolutley sure you should check with the clerk of the county court in the county you live in just to be sure;some states differ from one to another.But,it's the same general idea.I hoped I helped!! :)

Try paying them. Say something like "I know you're having a hard time and I'd like to help you, so I'll give you $100 if you'll move out." You can increase the amount up to whatever you're comfortable with.

Simply go to small claims court and file for an order of eviction. The process is simple, inexpensive, and the sheriff will physically remove them if they refuse to leave on their own.
