This is the second time they are planning to get a divorce. the first time the divorce wasnt finalized(they got back together) but this time my mom really wants to leave. when my parents went through the first divorce i was 12 and really didnt have a say in the matter. but now im 16 and i want to go live with my cousin, shes 40 and has three kids but two have graduated. the first divorce was really hard for me b/c i was stuck in the middle and was very depressed. so thats why i want to leave and let them take care of whatever buisness they have. I would only be living with my cousin for a year then my mom would move up to michigan with me. I know i have to get the judges and other parents consent but i was just wondering if i had a choice or not. If i can move to michigan and stay with my cousin intill my mom moves with me. Please help!!!!

If you get permission from both of your parents then it is possible. Your cousin could be made your legal guardian.

Louisiana law, much like everything else about the state, is chock full of tricky legal phrasing--espicially when it comes to laws regarding minor age status:

1. You cannot sign up for military service till you reach age 18.

2. You cannot enter bars, casino gambe or buy tobacco or alcoholic beverage products till you reach age 21.

3. You cannot obtain your driver's license till you are 17; your parents can obtain the driver's "learner's permit" when you're 15.

4. You cannot consent to have sex w/ persons OVER 18 till you reach age 17.

So you see the double standards on minor protection laws.

Louisiana's divorce child custody laws are brimming w/ gray areas as well. Currently, BOTH parents can legally assign your cousin to become your legal guardian--which ends when you reach age 18. When you blow out your 18th birthday candle, you can choose who you want to live with.

That would be up to the parents and your cousin. At 16 if you are not an emancipated minor your parents have the say of where you live. Talk to them.

no person who's sixteen can stand residing with their mothers and fathers. yet i'm going to tell you a fact: maximum young ones who run away and attempt to make a residing on their own are returned 2 weeks laters, tail between their legs, by using fact life is in basic terms too not person-friendly. i could like to verify you even attempt. stable success getting a activity, condominium, and so on. at your age.
