my children have my last name seeing as i was never married to their bio. father during our relationship and when they were born i gave them my last name and never put their fathers name on their birth certificate ... my question is when i get married can i change their last name to my married last name or would he have to legally adopt them .. i would prefer just being able to change their last name w/o the whole adoption scenerio ...



their bio. father is counted as their father for child support .. (that he doesnt pay) but other then that .. no visitation no nothin ...


btw i live in oklahoma


there is absolutely no reconsile with my childrens sperm donor .. he has not been in their life for over 6 years and my youngest he has never lied eyes on .. he is not their father he is their bio. father/sperm donor!

I have 2 children by two different dead beats. Only one pays child support. What he pays monthly wont buy a pair of shoes for my son. However both my children have my maiden name. The man I love, loves my children's. He's been there all there lives (18months & 6months). Now there 10 and 11 and he's still the only father that they've had. The changing of there last name should be up to them. If your fiance is a good man and father your kids will want his last name. Give it some time. Lord forbid you guys don't make it then what change yours and there last names again!

First things first, you just can't change their last names like that. You will have to do it the illegal way by having the bio father give up his rights to the children. Then once you have done that though the courts you then have to have your new husband adopt them as his own.

The bio father would have to sign a paper giving up all rights (which would then take awayhis responsibility of paying child support) to the children and you new husband would have to adopt them and then he becomes financially obligated to them.

You would need to check with your state laws about it but I think if your new husband legally adopts your children, their bio dad has to sign off on it since he is paying child support. I don't think that you could change their name to your married name. But you really need to consult a lawyer in your area to know for sure.

Do you TRUST your fiance to be a good father and to discipline your children?
If not dont marry and no more dating until they are grown and out of the house.
If you do then realize, he will be supporting them financially and be in the role of a father figure and part of that role is discipline.If he is not allowed to full fill that role they will not know how a father is supposed to be when they are grown.

in north carolina, my husband had to undertake my son. if the father isn't any greater suitable than a sperm donor, you mustn't have a problematic time with an adoption, that would make your loved ones finished...and legally, he could be the infants dad...

I think he would have to legally adopt them, but I am not sure...ask a lawyer first.
