I am in a child custody dispute in which one of the parents had used drugs but is supposedly not using any longer. But a the threat of a hair test is lingering... i know a hair test goes as far back as 90 days but how do you know if the parent is no longer using if they have stopped using in the past 90 days?

Depends on why the court ordered the drug test and the consequences the court provided if the test was failed.

If it is in regards to visitation or custody I would think the person that failed would lose custody (at least temporarily) and the visitation may be only with supervision.

A lawyer familiar with the specific case can probably give an answer as it relates to this case.

The hair can be sectioned to specific periods, like a week at a time. I say "can" because I have no way of knowing if they are doing that with the samples you are referring to. This would let them know approximately when the drugs were last used.

I'm just assuming here--I mean, didn't Texas execute a mentally retarded man? If they can do that, I'd say anything's possible there.
