It is only a violation of civil rights if forced upon you and you haven't done anything to deserve it. (eg: random drug testing in schools, etc.)

However, I do find the practice to be completely beneath me and would never allow anybody to test me voluntarily.

Good thing that my career is oriented such that I haven't had to take one yet and if I do, I'll quit and start my own business.

Like most topics, this is far from simple. All pre-employment drug testing is legal. Random drug testing of students in public schools is legal. Drug testing for safety-sensitive positions is also legal. That means you can drug test a police officer, but not the police file clerk. You can drug test truck drivers, heavy equipment operators and government employees using government vehicles. You cannot drug test the worker who is not in a position to affect public safety, like the CEO's secretary or my legal assistant. This issue was examined in the US Supreme Court case of Skinner vs. Labor Assoc in 1989 and that's been the last court ruling on the issue. The major issue remaining is the definition of a "safety-sensitive position." Finally, for employees, you can drug test anyone who has had an accident unless it clearly not the employee's fault, like a rear-end collusion at a stop light.

Since to join the Army , get a job , volunteer in a hospital , be in an auto accident if the police suspect you've been drunking,or a lot of other things require drug testing, either it's legal or everybody is violating your civl rights.
If you're clean, what's the problem????

I am by no means an authority in this matter but it would seem to me that in order to do so it would have to be specifically stated in the rental agreement and signed by all parties involved. I don't believe she can just suddenly decide to start drug testing tenants without a new rental contract.

Depends who is doing it. If it is an employer for a future or current job, then yes it is legal. If it is the police, then they need a warrant first, unless you where operating a motor vehicle.

For employment, yes. Workmans comp and insurance companies are not obligated to pay if you are found to be under the influence of drugs or alcohol.

Nope - perfectly legal.

Generally you agree to drug testing for something in return (free education at a public school, a job, etc.)

I THINK IF YOU ARE GETTING A JOB, GOT CHILDREN, DRIVING A CAR AND SO FORTH, YOU ARE PUTTING OTHERS IN DANGER, AND YOU ARE IN THE RIGHT TO BE ABLE TO SUBMIT A DRUG TEST. I ALSO THINK THAT IF YOU GOT IN TROUBLE WITH DRUGS THAT YOU SHOULD HAVE TO SUBMIT TO A DRUG TEST.

legal, since the drug testing is usually administered by private companies. parolees are usually drug screened by the government, but they gave up their rights when they committed their crimes.

for like jobs its totally legal. personally i think they need to be doing that at my job. i can guarentee half the people wouldn't pass.
