no the cop doesnt have to see or smell it to bother me in the first place because he is a residential (but real) cop. we were just smoking and all of a sudden here goes a flashlight in my window.

I live in Texas, forget the law cops in Texas do not follow the law. If a cop sees you he can arrest you, even with out the marijuana. Don't make eye contact criminals hate when you do that, they get defensive when committing a crime which all Texas cops are.
You don't have to respond but chances are he will start something with you and say you started it later and that is why he conducted an illegal search and arrested you for illegally seized items.
