I have been videotaping my neighbor from my property and the street. I have been doing this because they are running a daycare out of their home that is not licensed (by county or state) it is also against my CC&R’s. They have called the cops 4 times and every time the cops come they tell me that I am ok as long as I don’t go on there property. Then, last night I get served with an injunction against harassment (they claim that I am taping the kids). The cops tell me that I can no longer tape and that I can get a hearing at the local court. There is an open violation with the HOA about the daycare and they have meet with both of us to talk about the issue (they have sent violation letters- another neighbor has complained as well). They may have a hearing in the near future. I feel that I have a legitimate purpose for the taping, to document the traffic (persons and cars) and the daycare that is breaking the law. Does anyone know how to present this at my hearing?

Yep, did what you said to do and talked to an attorney. He will represent me at the hearing. No, I just video tape from my propety- nothing else. Trust me I am an upstanding person ( Army Officer) wife, job, mortage, child. The thing is that in this state AZ it is really easy to get an injuction on anyone. The courts would rather have the injuction served than let something bad happen. Hearing must be set in 10 days so that the injuction can be lifted if the person does not prove the harrassment. The thing is that if you get one of these served on you you only have 1 shot at a hearing- your correct get an attorney:)
