You should really check the laws in your state regarding this...and I would also call the bank and inform them of this, they are likely to offer their own solution...in my state a bank MUST verify the check they are cashing...the teller was obviously in another zone not to notice...cashing a check that doesn't belong to you is a felony...businesses (including banks) are no different...the teller is likely to lose his/her job or be punished for this..and btw, if you were charged a fee for the stop payment, I'd ask for it back as well....they should be more than happy to oblige you or risk stiffer punishment

First of all, you can not place a stop payment on a check that has already been paid. If in fact you went to the bank and cashed this check with a teller, as I am gathering from your explanation, then you just spent money you didn't need to placing a stop. So in fact you messed up 3 times. The bank processed the check and you were there for the transaction, if they didn't give you the proper amount - you should have noticed then. don't blame the bank because you are careless. If you are concerned go and speak to the branch manager. I am sure it was pure teller oversight.

...whoever has the gold makes the rule.
In this case the bank can pretty much do as it pleases.
Luckily you could stop payment.

Banks are corrupt. They don't give a rat's a.s.s about anything, as long as they can collect "fees" from users.
I guess you paid a fee to have the payment stopped?
Think of it this way: if you overdraft your account, it goes into the negative but you get charged a fee. Instead, why doesen't the bank just NOT process the transaction? They can see you don't have the funds available.
No. They just want their fee.

I know how you feel. We have an overdraft account to my daughters savings from our checking, (we always pay it back).I got a call from our tax lady, our check had bounced! No Way , I say. I go get cash out of the money machine & have to pay her an extra 15.00. So I take the cancelled check to my bank, asking for my money back. the 15.00 I had to shell out from it bouncing, when I had plenty in savings Apparantly too many checks arrived,before they were able to draft it out of savings.It just slipped thru somehow.They would not give me my money back .grrrr.HEY Squishy-What about me? Thanks Squishy,wonder where that check is hummmm.
