I want to start a website and sell alot of different things one thing I want to sell is stuffed animals would it be illegal to sell them from patterns you buy or if I saw a stuffed animals and tried to copy the way it was designed but added my own touch... or if I had one and I cut it appart to see how it was made so I could make one of my own.

Some people who copyright patterns would have you think so, but it is only illegal to make copies of their patterns and sell them. Not the actual item made using the pattern.

it is also not illegal to sell anything that is "changed" by you from the original.

these people are copyrighting their "intellectual property". You are doing the work, and can sell your work!

Annie's Attic people have been scouring the internet stealing other people's intellectual property and copyrighting it for years. Some patterns I have had for 40 and 50 years are suddenly copyrighted by these people. What gives them the right to copyright other people's stuff!!!

I have to agree with mliz55. Wanna get high doesn't know the correct answer as all patterns and tutorials have a copyright even if they are not registered with the US Copyright Association. You must obtain permission from the person or company to find out if it is not stated on the pattern or tutorial you are talking about. If you don't have permission and you are found making and then selling them you are breaking the law. If you are using them for personal use only then there is no harm done. It's when you step over that boundary and start selling that it becomes an issue.

What seweccentric said is correct. A few friends of mine sell crafts and cloth diapers and they can't even start their designs from store bought patterns. Or base them on patterns that other sellers have. Copyright prosecution could result if they do.

However, if you really need that pattern to make your pieces you could look into getting a license to sell items made from that pattern. You'd have to work out a deal with the person or company who owns the pattern copyright that would probably involve paying them a one time fee or a fee per item or a percentage of each sale depending on the company.

The designer *may* legally reserve some of the copyright rights when selling a pattern. It's routine for the right to commercially reproduce be reserved (available through separate license). The production of a pattern from an original by the designer is one thing. The production of a pattern from an original by someone else is a second thing. The production of *items* from such a pattern is a third thing.

Example: Disney can license a designer to produce a pattern for people to make a "Stitch" toy *limited* to personal/home use. Looking at the pattern and changing a few things doesn't "get around" the rights of the *original* designer.

Basic bad case scenerio: you put umpteen hours and dollars into production and the items are *confiscated* at public display/sale by legal agents of the copyright holder.

Please be "inspired by" what you see, rather than copying. Learn to draft patterns from "scratch". Good luck.

I have seen websites that state that patterns not to be sold, but items made from the pattern can be...I have seen this mostly with the knitting and crocheting web sites. Your added touch makes it more unique,and not original from a pattern, that is if you make enough changes.

As long as you make yours different, it's legal. Your stuff is copyrighted as soon as you say so, but don't expect to be able to enforce it. Just be ready with the next great thing! And make sure you advertise that yours is the original, exclusive one of those.

No, it isn't. I used to sell my own custom stuffed animals that started with pattern, but of course then changed to my own designs, as you are doing. Here are some pictures of my old designs (sold quite a few of these):
