You have the right to be judged/selected under the system devised and agreed between your employer and the Union.
The legal issue is whether there is a fair and reasonable system.
Whether you think it is or it isn't, the Employment Tribunal will be satisfied that this system, under a collective agreeement is fair and reasonable.
If your question is suggesting you should have the right to a different (individual) redundancy system, I can see why you might want that, but legally you have no right to it.
I hope this helps - even if it gives you no comfort.

absolutely no say what so ever, i was made redundant from my work in June, they made their decision through a point system also, if your employer wants you out they will succeed, i was in the union and they didn't do me any favors, unions are a waste of time. they decided on a redundancy package with the company, and whether you were in the union or not, everybody got the same deal. they wiped out 75% of my department. i know its frustrating not knowing if your going to keep your job or not, but things happen for a reason. try to keep your chin up!

If you're NOT a member of the Union, then you are getting exactly what you deserve!!! Btw, it's not the Union that's deciding whether you stay or go, it's the company or corporation. The union is just allocating the available positions. And the reason they have the power to do that is because the Union laborers are acting collectively instead of individually.

Humm, you do not benefit from individual agreements between your employer and your union if you are not a part of the union. with universal minimum contracts that cover the whole workforce it is different, but this is not the case here.
Why not join the union? It doesn't take that long, and the fees can't be that bad.

the points system is the way they decides who stays and goes,
this is probably on years worked, position etc.
this is what every one will get judged on and it does not make a difference if you are in th union or not.
its just the way the company has decide to go with.
join the union if you want,
but i dont like them or think they do any good.

I think you have a good case to fight.....It is a choice to be a union member and it seems quite discriminative that non members should suffer through that choice
I really dont think that....if it went as far as a tribunial....that the court would accept it as a fair trade....
something wrong there somewhere
