McDonald's has been legally made a 'brand' name that no other fast-food restaurant can use that name. It's a trademark, that people recognize the brand name, same as the Golden Arches associated with it. (This is an Economics question) When you create something that is super-great, or you feel will become superduper, you trademark it so no one else can use it, like Tiffany Diamonds, MicroSoft. For example if you make junkie computer software, slap the MS label on it and sell it, Microsoft will come after you for selling an inferior product in their name. Reputation is everything to a product/service.

McDonald's is a brand name with it's trademark and logo of the letter M in yellow and the use of it's mascots. Anywhere you go, you can recognize McDonald's via these things.
