I am being prosecuted for something I didnt do and I have a Public Defender because I dont have alot of money. But going into a trial I want to be sure my lawyer is going to win my case....and I dont know if my lawyer can. What are the signs of a bad lawyer/good lawyer?

I have very good evidence in my defense. I just dislike my lawyer, he doesnt seem to give a damn and he is very informal. He is buddy-buddy with the DA it seems. He hasnt encouraged me at all or made me feel like I could win my case. He is very casual and blaise about it. ITS MY LIFE! Jeez....is it normal for a lawyer to care so little?

Strong sense of ethics -- willingness to sit down with the client and explain things to ease their fears -- a concern for the client, that goes beyond the case file and statistics.

Legal knowledge helps -- but compassion helps more.

It is not your lawyer that "wins" your case. All he can do is present evidence and file the proper pre-trial motions. It is the jury (or judge if a bench trial) that is going to find you guilty or not. You could spend $50,000 or more for Gerry Spence. If you don't have any evidence or facts on your side it does not matter who your lawyer is because the jury doesn't care that you paid a whole bunch of money for a big name lawyer or not.

I do not look at it is bad v. good lawyer. I find there are two types of lawyers: competent v. incompetent. I find a lot more incompetent attorneys in private practice than I do working for public defender offices.

A good criminal lawyer has a law degree and has practiced in his/her area of law for at least 5 years. You don't want someone who practices primarily in divorce law representing you in a criminal case!
