Hi I am a second year college student at UCSB and I live with three other people. Two of which are now growing marijuana plants in the house not too mention smoking it constantly all day. We are in a legally binding contract for about another 9 months and they did not start smoking until march and contracts here are signed in january. Otherwise I would have seen this problem coming. I am tired of the house constantly smelling and afraid of getting in trouble if I do not report it. I have also gotten a lot sicker since I moved in here about 3 1/2 months ago. I looked up prison terms of up to 5 years if you are caught growing and selling. What I would like to know is, a) should I contact management and b)if they get caught by the police and I live there, could I get in trouble ?

P.S. Their housing contracts would be terminated since smoking in the house in the first place is a hundreds of dollar fine by our company to begin with.

And I don't want no dumbass remarks from stoners

DO NOT GO TO ANYONE ELSE EXCEPT AN ATTORNEY!!! If you go to the police - they can arrest you if they want to. If you go to management, management can call the police and the police can arrest you if they want to. My advice: get a camcorder and record your friends smoking (if that is possible without putting yourself in danger) and record where the pot is located. Make sure there is NO POT in your room. Take this footage to an attorney. An attorney can help make sure you aren't arrested. You DON'T want to go to jail for dealing!!!! You could be in prison for years!!!! This is serious stuff and could affect your entire life. Don't play around with it.

Not all stoners are dumb asses. You could narc and run the risk of getting your *** beat or busted or just move out and leave it all behind and make an anonymous call once your out, or let it slip that someone has been smoking in the house so you all get kicked out. Can you sublet your room to someone who is a little less uptight, that way you get out of there without the financial obligation. If the house gets busted you can get in trouble for being and accessory, just because you know but didn't tell. Once again, not all stoners are dumb asses, what do you think about drinkers? Bet that is OK cause the gov't says its legal huh.

a) yes
b) yes

You are at risk if this is found out some other way than by your telling the management. The police, or your roommates, might claim the plants belong to you. This is the most common thing someone says when busted for drugs: "I was holding it for someone else, it's not mine".

Contact the housing office and ask for some kind of transfer. They will know what to do next.

You will almost certainly be charged along with them if the police find out and raid the place. Your best bet is to contact the police yourself before that happens, best via a lawyer. Take care of this now or you can go to jail, or at least will have to spend thousands of dollars to defend yourself.

I'm not exactly sure of the law, but I would think you could be in trouble as well as everyone in the apartment if the police were called and they were busted. Just for the pure fact that you live there also. Wow, that's kinda messed up .

a) Yes, you definitely should contact management. If your roommates are engaged in illegal activities and your landlord fails to stop them, that is legal grounds for voiding the remainder of your lease and moving out without consequences normally associated with breaking a lease early.

b) You can't actually get in trouble, but you will have to deal with a lot of hassle of going to court and testifying, etc.

Try not to get your friends in trouble. Go to management and see they can give your friends a warning. They can lie and say they smelled it in the room.
oh and get a lawyer first.

GO CONSULT AN ATTORNEY FIRST THING IN THE MORNING. Get your own representation FIRST. Many will help you out for free. They'll help you go to the cops & can your roommates, while keeping you out of jail, etc. They can probably help you break your lease as well.
