My friend just moved in with me and things are really not working out. She never does any work and she hasn't got a job yet and she just sits and cties all day and watches movies. She is not in the lease and the landlore doesn know she is living here with me, What is the best way i can kick her out without dissapointer her or upsetting her?

If she has been there more then 14 days you can not legally kick her out. You need to file an eviction and get a court order. It doesn't matter that your landlord does not know, or she pays no rent, you willingly let her in, she did not break in and trespass.

You need to treat her as a month to month tenant.

Give her proper written notice to terminate her tenancy - no cause or reason needs to be stated.

Check your state's landlord tenant laws, but generally, the notice must give her 30 days - including a full rental period. Notice given today, would give her until November 30th to vacate.

If she doesn't leave by the termination date, you have to evict her through the courts.

Talk to her first, and see if she'll go willingly. If she won't, you might have to give her notice, depending on where you live and how long she's lived with you. And this could all cause you problems with the landlord too - you might be in violation of your lease, and if so, YOU can get kicked out.

i don't believe that any way you "kick her out" will not be disapointing or upsetting her, if she is not on the lease you have no legal obligation to let her stay, however.. a moral obligation is another story, kicking her out in the streets with nowhere to go is something you might not want to consider, especially since she is a friend.

act like the landlord knows and that he told you that she had to move or you would be kicked out too (like too many people in the apartment or something)

i know it's a lie, but i think it's probably the best way to get her out without hurting her feelings

I hate to be bearer of bad news but here in NC you would have to evict her even though you are just letting her sqaut at your place.The laws for eviction read here that you let someone stay more than 36 hours then they are considered a resident and even the law cannot force them to move out.Good luck!

Tell her landlord found out and is threatening legal action unless she packs up and gets out.

get rid of her...there is no nice way to be honset... shes using you sweety.. you should be mad. dont let her turn this around on you. tell her hey you having gotten a job and i'm supporting you i cant afford this you have to find a new place to live sorry
