We buried my grandfather in 1974 on private property in Virginia. When the property was sold, the new owners were made aware of the graves that were on the property. In that area, it is designated as a graveyard and it's protected for 100 years. So, they cannot do anything on the graveyard. (I don't know what the law is after the 100 years expire...)
I do know that after a period of time, you can build on grave sites. If they find bodies, they have to be moved to a new location. This can't be done on new burials. Hope this helps you.

At first I thought they where just animal bones until I found a human jaw. At first I thought to call the authorities but when I talked to the previous owner he said it was probably a slave graveyard. I replaced the bones and modified the size and shape of the garden. A few years later our home was condemned for a new highway. We bought the house back from the state for a dollar and had it moved. While the construction crews started digging, I alerted them to the grave. They called the authorities and had the University of Virginia move the grave. They found two young adults and four children in total, all very interesting. In the years I lived there I was never concerned or bothered by ghosts or evil. RScott

We found out, after the fact, that a home we had built was partially over a single, private, grave. We had to move because of the wiwerd things and noises that we heard and saw. We constantly heard someone walking around up in the attic, but when I'd go up there to check, there would be no-one. Also, a little girl, that was visisting, got about halfway up the stairs to the upper level bedrooms, when she literally came flying down and landed on the tile entry, knocking her unconcious. When she revived and we asked her why she jumped off the stairs, she got angry at us and said she was "pushed."

A grave yard can be moved.
The corpses dug up and moved to a different location. If you check with city hall they will have the records on whether this happened.
The problem is that the ethereal essence of the departed do not move just because the bones were moved.

I have heard of peoples houses being built on indian burial ground... ever seen the movie amnityville horror? That is a true story and it was built on an indian burial ground. Time to start hanging some crucifixes and call out Ghostbusters...
