My son's mother has not let me have not one visitation in 5 years. NOT ONE! And the law will not do anything. Yet you let me get far enough behind in child support payments and I go to jail. That tells me that the world is centered on money and not the well-being of the child. It's not right. Not at all.

The Law can do something about it. As the child's father you have every right to visitation. The only reason that a court wouldnt allow you visitation if there is a risk to the child. Child support IS for the well-being of the child. It helps with their schooling, clothes, putting food on the table, helping pay utilities, etc. I think people get a bit mixed up about child support. Child support is to help the child....your child. Why did you get behind anyway? You may not be able to see him, but don't you want to see that he is well taken care of? Don't you want to help out with his schooling, etc? Dont you want the best for him? Your son didnt ask to be born.

Well you are entitled to see your child but you have to let it be court ordered. The fact that you let it go on for 5 years does not help your case. When she does not go a long with a court ordered document it is considered contempt of court and she can go to jail. You have to push the issue though. Just like if you are not paying child support who do you think is the first to pick up the phone and call dss? Her! If you feel you are not being treated fairly then make payments on time and take her to court and let it be know that you are not able to see your child because of her. Things will change after that.

She is keeping the child from you because you are not paying. The well being of the child DOES come from money, money helps the child be fed , clothed and raised in some type of structured security.
You shouldn`t be so far behind in payments that it causes a problem. If you can`t pay, then tell your lawyer that, so arrangements can be made. Now if you`ll excuse me, I`m off to work , `cause I have kids of my own to pay for.

It's called contempt of court in my state. You have the right to visit with your child if it was ordered by a judge. It sounds like your child's mother is following the proper legal channels to make sure you are paying child support, you need to do the same to have your visitation. It stinks, but that's the way it is.

Well I am sorry to say it like this you wife needs to let you see the child unless there is a good reason not to and you need to pay child support because you need to help her with the maybe there is not a law but you can go back to court and depand that you see your son you do not do this becuase you do not want to but you can see your son let the judge now that you think that she is hurting him mentally and that you as the father of the baby need to see him to make sure that he is okay.

why did you not work this out during the divorce ? I would think that would be one of the first things you would discuss before you get to court . I think maybe you should petition the court for child visitation rights . it means getting a lawyer again and going to court again make sure that it is worth it . good luck .

i agree with you havent seen my kid since 98 and i did get behind 300 had to spend 90 days in jail over that not for failure to pay child support but contempt of court for failure which makes no sence and a good lawyer wont help much because it is about the money anyway and the state can charge interest on arrearages that your child will never get and if you go through 2 states they both can charge you interest was paying 19% on mine for about 6 years which amounted to about 900 bucks good friggin luck

You can get a court order for your visitation rights. If you pay she need to let you see your kids. It is law, just need to take her to court. It is about money either way.

I SO understand you-My fiance got a girl pregnant when he cheated on me (yes-very crazy!) and when he & I ended up working things out, now she is bitter and wont let him see the kid yet he has to pay child support to her. Its crazy! We have been told the only thing we can do is hire a lawyer (which we cannot afford) to get visitation. UNFAIR

Like LB said, get a better lawyer and sue her...she is in contempt of court IF there is a vistiation order. It's not HER fault you have a lousy lawyer and it isn't the LAW'S fault.
