Hey ya'll! i am currently 15 years old, will be 16 in june of 2008. I want to get emancipated this summer, but I am not quite sure of everything I will need to do, and I don't want my parents to know about this until it is official, so I can't ask them for help. Will they still let me be emancipated if I'm not in an abusive home? I just simply do not like my parents at ALL, and they are way to strict and refuse to let me see my boyfriend. But who do i go to, to get emancipated and like what do i tell them. will i need a lawyer, and will it cost a FORTUNE?? Because my parents wouldn't help me in any way with that. And also, I live in north carolina, will they rent apartments to a 16 year old? Me and my friend are going to rent one. Ya'lls answers would be greatly appreciated, thank you soo much!!!

Don't rush your life away. You are right, it WILL cost a lot and will keep on costing the rest of your life. Boyfriends may come and go but your family is still your fam forever.

First your parents get notice when you file a petition for emancipation. So you will not hid it from them. This petition asks the state to declare you able to act as an adult. This means the court has to find you are not dependent, meaning you have independent means to support yourself (a job, and a job that makes enough money to pay for your basic needs - approximately $800 a month.) Just wanting to be out from your parents control is not good enough. Yes, you can rent an apartment if an apartment owner will rent to you (credit worthiness is the issue) if you can make a contract. In most states one cannot make a contract until you are an adult (18). The determination you are emancipated, effectively makes you an adult. So you will need to show the order of emancipation to the landlord when you apply. However, if you do not have a credit rating, you may not get the apartment anyway. Best way around this is once you get the emancipation, and before you leave your parents (which once emancipated, they could effectively ask you to pay rent) you will need to apply for a credit account somewhere, like a local department store or retail store. You will have to show the emancipation order so they will take your application. But so long as you have the job, they will qualify you for a small account, say up to $500 in charges. Once the account is open, charge a small purchase (under $100.) Then pay it off in the next 30 days. This effectively proves you are responsible in using credit, and your actions will be noticed and rated. This will give you a credit score withing 60 days and that is absolutely necessary in most apartment transactions. The only way around this is renting in a college town where most apartment owners are used to dealing with students of an age who do not normally have credt ratings and such. Personally I would recommend against this action. Personally I would call a counsel with my parents and discuss with them as an adult the issues you see are bugging you. If you maturely discuss things with them, you maybe surpised at how they respond. Most parents want their children to grow up and leave. One can not immagine how a parent feels seeing a child go out into the world fully imformed and able to be independent. You may not understand they seem controlling because they worry about you and the choices you make. You may have actually lost some trust with them and do not really understand this. A family counsel just might help clear the air. Your unwillingness to let them know of this action makes me wonder if you do not trust them with your secrets. Have they caused you harm? Have they really acted hateful towards you? Open the communication. What you do not realize is that parents are your parents forever. At 40 years old if disaster strikes who in the whole world would help you first if they were asked. I assure you parents are not something to discard. Your relationship with them has to change. They know this, they did it with their parents. The problem is you have never been a parent. They have been children once. They might have to be remined, but they actually know more than you do and if they are okay people (most are) they just need to be reminded to remember how it felt being a child once and how they wanted to be treated. Running away to become an adult sounds wonderful, but I assure you growing up too soon usually meets with failure. Only the really talented and lucky can start out emancipated at your age. Good luck I forgot to mention, you can not hire an attorney unless you can pay for it all up front as the attonney can not make a contract with you until after you are emancipated. You have to file this petition on your own, and in most states there is a filing fee of about $200. You file this action in the juvenile court of your county or precinct. The clerk of the court can provide you the forms. And as noted your parents are send a copy of your petition and may attend the hearing where you ask the judge to declare you emancipated.

If you cannot give grounds for emancipation - and no "I don't like my parents because they won't let me see my boyfriend" is not going to cut it.

If you did apply for emancipation you must prove you can live on your own completely and totally on your own. Financially as well as maturity.

You asked this same question yesterday and got mostly great and true answers. Your reason for wanting to be emancipated will not work in court.

Unless you can afford to take care of yourself 100% WITHOUT a roommate, its not happening for one. Two, if this is all because of a boyfriend, maybe there is a reason. PLUS, you're 15. Sorry honey, its not happening.
