Recenlty had a tenant that lived in my condo for a little over a year, and just left. She had not paid rent for two months and left my condo in Utter Shambles. I do not know where she moved to and I am wondering what can I do to get the money she owes me, and can I claim property damage. The women set my stove unfire over the summer, the carpet is filthy, the entire unit is absolutley Filthy, it will take atleast a month to scrub the place down. She never paid a security deposit, because she was a single women going through problems in the begining I felt horrible for her, because I had gone through the same situation and we were to agree on some type of payment plan in regards to working out the security deposit. Any advice would be fantastic.

Ugly situation, but if you cannot find the tenant, you cannot successfully bring suit against her. Even if you DO find and sue her with success, getting collection on your judgment will be difficult, to say the least.

Without doubt, you would probably be granted a money judgment, and I would pursue it, just in case this woman should happen to come into money, or attempt to buy a house or similar. A docketed judgment will interfere with those types of occurrrences.

Be sure to document the condition of the property with photos, and keep receipts of your costs to restore the unit. You will need these to obtain a judgment.

I wish I could give you happier advice, but what I have posted is the brutal reality of the situation.
