We have been married for 2 years but together 4. My husband has no job and sits around playing video games all day. We have a two year old son together. I have told him that I was unhappy and the straw that broke the camels back was when I wanted to have sex with my husband because I am a very sexually active person and he told me having sex with me is like a chore. I started talking with a man that I work with who is older. We started flirting and things just progressed. Now this other man and I are having sex. At first I didn't tell my husband that I was having an affair and he found out. I can understand that he is mad and hurt but when I go out with this other guy he says he doesn't want me to lie about where i have been. So I told him the truth and he asked me if I had sex with him. I said yes. He called his mom and his mom called and asked if we used protection. She said that I in WI you can't get divorced if you r pregnant. Is it true, if I do get pregnant?

I live in Wisconsin and yes you can get divorced even if you are pregnant with his child. I would think he would want to get a divorce if you are pregnant with another man's child. In any case it sounds like your marriage is over so talk to a lawyer.

Can you petition for divorce when you’re pregnant? Yes. Does a judge have to grant to it? No. And many judges won’t grant the final order until after the child is born, so that they can address the issues of paternity, custody, child support, etc.

Just to mentioned this…
In the state of WI adultery is still technically illegal, and it’s a FELONY. And while it’s unlikely that anyone has been charged with this crime in a long time (although, I don’t know that), you’re still technically committing a felony. You might want to rethink that.

The below link gives you all the requirements of getting a divorce in WI. It does not state it will not give you the divorce but it does state you should have been living apart for at least 12 months.

If you have been living with your husband, and he has not been working, and you are pregnant by another man, your husband could award your husband alimony. You have been his soul support for a while and you have been unfaithful to him. This could give him grounds to hold up the divorce and for him to get a portion of your money.

Good Luck

LOL you can get divorced at any time for no reason. You just have to pay for it. I think you should get divorced though... I mean you're having an affair, you don't intend to stop, so why stay married??? As for my opinion, its too early to start in on people like you... Just know Karma will come back around...

Married but having sex with another man. WRONG!
Check this out. Your husband might be a jackass but you committed yourself to him. Why get married. If you are sexually active then you go and buy some toys and you do it yourself and if you want him to join then you have to work just a little more to get him to play along. Make that man put downt that controller. I have yet to find a man that will turn down a woman in her bed with toys and loud moans and groans and just out right pleasuring and never put down a controller to find out what's all the funs about. Get him in the mood and stop cheating.

Job situation let apply for him and tell his lazy *** he needs to get out there and work.

Call your local court house and ask them, or call a lawyers office and ask.
