My mother has been estranged from her husband for 4 and a half years. Neither my mother or stepfather want to deal with a divorce. They have an 8 year old child together and just don't want to deal with all the mess. They get along o.k. they just can't live together. So what exactly IS a legal separation, why do people get them, and how do you go about doing it WITHOUT a lawyer. I'm asking about the "without a lawyer" because my mother is extremely broke, and can't afford one. She is looking into section 8 housing and needs proof that she isn't with my step father anymore, so I thought that maybe a legal separation would work. Any Info would be GREATLY appreciated.

in the state of pa there is no legal separation. there is only divorce. the only thing i can think for your mom to do is to have your step dad write a document saying that he is no longer living with your mom and have it notorized. maybe the welfare office will accept that.

She needs to go to the court house and file the papers. Or just live apart nothing is wrong with that. Call the court house and ask them what to do.
