My husband and I currently live in a one bedroom apartment. We are expecting a baby. Will we be required to move out when the baby arrives even if the lease is not up yet?

FYI: In my state it's 2 people per bedroom. At the most, the landlord will allow only 2 people to live in a one bedroom apartment. If it's 2 bedrooms, they allow 4 people. You get the point.

We signed the lease before I found out I was pregnant. By the time the baby arrives, we'll still have 5 months left.

I've heard of some couples having to move out of their 1 bdrm apartments because they had a baby, even though their lease wasn't up yet. So I am just curious if it can happen to me too.

forcing u to move because u have a baby sounds like a public relations nightmare to me.
now when ur kid is 2-3 , i would suggest for ur sanity getting a 2nd room.
go to management and ask. don't waste time or energy woorying about what might be with out knowledge.

Usually the saying is one bedroom 2 hearts etc it's not usually an apartment complex thing but a housing authority requirement, they are trying to prevent 10 family members living in a one bedroom apartment, trust me it happens. However, I'm sure that you won't want to continue living in a one bedroom apartment after you have the baby. By the time the lease is up the baby will be ready for it's own room. I doubt you will be asked to leave the landlord cannot ask you to move out prior to the lease expiration unless you stop paying or violate the lease in any way. They might suggest that you get a bigger apartment once the lease is up but even then they can't force you to either.

I don't think you have anything to worry about. Your baby will be 5 months old when your lease is up and that is plenty of time to find a larger place. A lot of parents keep their infant in the same room with them past the age yours will be. Landlords state two to a bedroom because they don't want to many people living in such a small space. I am a landlord and I wouldn't be asking you to leave.

Wow! Which Soviet state do you live in where the state mandates you have to move to a larger place if you have a baby?

You live in the USA, right? Unless you are getting state assistance, I don't really think you have to worry about this.
