My husband is a mean angry man with a bad drinking problem. He went to jail for beating me up. I have moved away from him. What happens in court whem someone is charged with Domectic Violence?

I am going to court because the court automaticly takes the case in my state.

it depends on what state you are in but in most states there is an order of protection or restrain ordered issued. in NY if you are charged with dv there is an *** ult charge or some other kind of charges what will happen depends if it is a felony or a misdemeanor

Like in most criminalcases,the Judge weighs the evidence against the severity of the charge and listens to any and all witnesses including the victim. He can request a jury trial of his peers if he chooses or just plead guilty and plea on the mercy of the court and take whatever sentence the Judge hands down

It depends on the state you live in and how many times he has been arrested for this. Usually he will be ordered to stay away from you, probation, and some kind of anger management classes, maybe even jail time. Or they could make him do some rehab, and anger management. He might have to go through some sort of 12 step program.But, most likely he will be ordered to stay away from you. You should stay away from him.

Think what exactly you want before you go to the court. Whatever you say in the Court, you shall be in a position to submit sufficient evidence to the satisfaction of the Court.

depends on the mood of the judge in my state, why are you going to court if you moved away

he will go to jail , will not pass go , and you need to get a restraining order and a divorce immediatly, next time it might be fatal.
