Okay, i was wondering a lot of stuff, not for a report just for my own knowledge. What is the legal age to have sex if your going to have sex w/ someone over 18? My sister said it is 16 but idk. And if 2 minors have sex can one get arrested for sadulatory rape? And if 2 minors have sex and the guys parents found out and want the girl arrested for rape but the guy says it wasnt rape will the girl still get arrested? and wat about the same senario but the girl was over 18.

1) a person under 18 is NOT at fault for having sex with someone over 18
2) statutory rape ONLY involves sex between someone over 18 and a minor
3) in any other charge for rape other than statutory, it must be proven that the defendant (male or female) did not have the consent of the victim. If "no consent" is not proven, there is no rape and the angry parents would have to just shut up.

Each state has its own laws concerning Criminal Sexual Conduct, and the age of consent is also different in each one. New York, for example, is 17.

I do remember a case in Oregon several years ago where two 15 year olds engaged in sex. He was convicted of statutory rape and sent to prison. I'm not sure how that worked since it was consensual between both, so gender discrimination laws should have come into consideration.

Still, there is the fairy tale that all little girls are innocent princesses and all little boys are filthy monsters just slobbering to ruin them.

By the way, aren't you the same person who keeps asking this question about a woman over 18 having sex with a kid under 16?

It depends upon which country you are living in, and which state. The "Age of Consent" in the US varies between 14 in Hawaii to 18 in other states.

In Australia the 'age of consent' is 16 while the age for marriage is 18. In Canada the age of consent is 14.

As for sex between a person above the age of consent having sex with a minor, then it is STATUTORY rape.

I do not know the laws in the US in regards to two minors having sex, but in Australia it is not Statutory rape if the difference in ages is no more than 18 months.

Many countries have the age of consent at around the 15, but even in some of them, many have marriages at 12. In India the age of consent is 15 but many girls are being married off shortly after mensus. The same in Indonesia with the consent of the local Imam (Islamic religious leader).

There are countries in Africa, not all muslim, that allow for marriage of girls at 9 (pre-mensus) and the girls are expected to have sex with their husbands.

16 in california but sometimes a judge will throw it out if the minor is 15 and nearly 16...but the adult has to be 18...if the adult is 19 the minor has to be atleast 17

relies upon on the state, In maximum states that's formally criminal for a guy or woman to have intercourse at sixteen yet merely with different sixteen-17 year olds. as quickly as a guy or woman reaches the age of 18, you're merely legally allowed to have intercourse with 18+ yrs previous.
