My brother has lived in an elite suburb for about 20 years. The well-off people who buy homes in this area, for the last 5 years, have started tearing the existing homes down to build new ones regardless of what shape the existing home is in. They are after the land in that area and have money to burn.

He is now trying to sell his home and suddenly the powers that be in this 'town' put a condition on his plot of land saying that if a new home is built there, it can only be half the size of the old home. This has killed not only the value of his home but any sale that could have been made. Is this legal?

His house is on a corner lot and I think that is part of the issue. I will check into the law being applied to lots of equal size. Thanks so much.

Yes, it is legal, as long as the same rules are applied to others with similar sized lots. Others who demolished and built prior to this ordinance are, of course, grandfathered and would not have to reduce the size of their new homes.

If the powers that be be the city or town or county then you best believe it had better be legal or they are setting themselves up for a change of governing forces! This sounds like a reverse mcmansion issue they want the houses to grow smaller for some reason. Check the local newspapers for what is going on. Many of them are online.
