and the business went bust. They went bust 22 years ago but They are still paying (well she is) off the debt. Her ex wont pay any money back and is drinking heavily. It was his business but she was a partner. Is there any way she could make him pay or get out of the rest of the payments? She wants a divorce, will that help? She is getting very depressed at not having any money but he has lots?

Get a lawyer. No, a divorce would not solve the money problem.

If she has paid off her share of the debt and she has equal share in the company, she should technically be scott free if there is proof that the partner has more than enough dough under his name to clear his side of the debts.

She need to see an attorney as soon as possible and if she is just now getting the divorce she has the upper hand. The judge will probably give her half his money plus all she has paid into the business and may even make him pay that off. Tell her not to get depressed, get even!!

It all depends on how their Deed of Partnership was written. Find the original paperwork and see what it says about the share of debts. Have you seen legal advice ..... would be a good idea !
