Just recently I tried to make my minimum payment for my bally membership, which was $29.97. But when I paid online, they took
$459 onstead. I called them to fix the mistake, so that I only paid them $29.97 and not the full price for the entire year. They said they would give me a refund. But I didn't get it. So I called Bank Of America claims department to dispute Bally's charge. n Bally's gave me a refund. I got my money back. But then Bally's claims that I owed them $422.05, which I never took from them. Does anyone know who I can talk to? I don't have any money to pay for a lawyer.

What I would do is tell them that you reported a problem with your payment and when they didn't seem to fix the problem you went to your bank. Since your bank issued a credit, it's possible Ballys also issued a credit in which case you would have been refunded twice. Tell them you want to wait a week or two to make sure all transactions have cleared before proceeding. After that time has passed, get print-outs from your bank or your bank statement and look at what happened. Do you see the deduction for the original $459. Now do you see a credit for $459 or do you see two credits for that amount. If you see two credits, that means you owe them $459.

It's also possible when you submitted the payment for $459, you mistakenly submitted a contract for a 1 year membership and their records are screwed up because they think you should have paid for a year but only received 1 month.

I suggest you call Ballys and talk to a supervisor and explain what happened. And then see if you can work things through. I don't see any reason to be worried about lawyers and collection agencies at this stage of the game.

It's also possible the bill for $422.05 was automatically generated while all this other stuff was going on and that it was just a mistake.

If you've talked to someone and they can't give you any kind of explanation, then ask to speak to their supervisor. Make sure you are very firm on the point that you don't believe you owe anything and you want them to carefully review your billing and payment history. In fact, you could even ask them to send you a print out of your billing and payment history as backup to the them saying you owe $422.05.

Since this is a prepaid service, you can always tell them to just cancel your account and take your business elsewhere. As soon as you threaten to cancel, they will more than likely take your claim much more seriously.

Get a printout of your bank statement, go to Bally and raise hell. The customer is always right. Don't back down. Yell and make a scene. I'm not kidding. It works.

wow, that stinks. i recommend putting your complaint in writing and mailing a copy to their billing department and customer service and keep a copy in case it becomes a court issue. then go into your gym and ask to talk to the manager and stick with it til it gets cleared up. if you find the person you are talking with to be not helpful, ask to talk to their boss. also, contact the better business bureau. this crazy corporate beaurocracy madness is really really annoying, huh? good luck.
