even if its a short marriage of 5years? and also even if husband is paying mortgage?even if wife has signed homestead waiver?

yes there is unfortunatly but I thought it was better to lose half my stuff than to keep all of her

Homestead waiver means she won't go after the proceeds from the house when you sell it. She should be paid half of the equity at the time of the divorce unless otherwise stated in your decree.
And yes it is 50/50 even if the wife is not working outside of the home. Because she is working in the home! Unless you have assets that you have kept seperate from before you were married then you share all joint property and financial assets after debts are paid.

ha ha lol this is crazy I think that if she is not working she should recive something for keeping house , but to get half is just plain crazy
