I've not seen any such laws specifically banning below-ground houses, but there will be hurdles.

Building codes will require that they be totally leak-proof to be inhabitable, and whatever is above ground will have to comply with any zoning ordinances, and any applicable aesthetics of any covenants.

If you want to do this outside of any city limits, you can probably do pretty much what you want to do.

It all depends on your local zoning and planning laws. We have no clue. Call the courthouse or city hall and ask them.
