Unfortunately I got my license suspened for DUI in Santa Cruz and I was under 21 so they suspended it for a year. However I have no choice but to drive to college. I would like to know if in the event that I get arrested for driving without a license would that year be extended even further in addition for impounding my car and giving me a $1,000 fine and some days in jail? I hate cops and if I didn't have to drive I swear I would't just to not see them around plus I think that its extremely unfair to be treated like a criminal for doing something I have to do. I requested a hardship license from the DMV but they were nice enough to reject it.

I know some of you are strict and will say that I am a criminal for driving under the influence (some people even say the laws aren't harsh enough) but... first of all I wasn't drunk If I was impaired I wouldn't have driven... second of all we all have to party and unfortunately I live in a suburban place

you got a DUI in my town, so i'm happy they suspended your licence. the problem with this is that they don't ever enforce the suspension until you drive drunk a few times and then finally kill someone (like that woman named April who ran a girl over in Boulder Creek and now there are flowers on the side of the highway marking where the girl died). You can get your license permantently suspended if you don't follow the rules and they catch you. My suggestion is to get up earlier and either get a friend to drive you or take the bus until your year is up.

p.s. be happy that they didn't pass the idea of putting DUI in big red letters on the licence plates of any car owned by a person who has been convicted of a DUI....

First of all, if you took driver's ed you should have known that in CA, if you are under 21 anything over 0.00 blood alcohol is a DUI. That means if you drank anything. I know you want to have fun, but it IS illegal to drink anything and drive if you are under 21. If you literally have to party, you should either have a DD, or sleep it off before you drive. Stop blaming other people for what you did.

As for the DMV, try again for the hardship license. Don't drive, because the last thing you want is to get arrested, have your car impounded, be fined, etc. Even if you drive very safely, there will be cops who pull people over for going 27 in a 25 zone, or for not stopping completely at a right turn at a red light. And of course, there is the DUI checkpoint every so often, where they check everyone's license.

I know that the public transportation in Santa Cruz probably leaves much to be desired. I suggest you call a cab to take you to and from school. It's slightly inconvenient, but doable, and you won't be risking anything. If you literally can't afford a few dollars a day to take the cab, even after you stop paying for non-essentials like alcohol, get a part-time job either on campus or within walking distance from your house.

It really depends on the judge. They can't start the year suspension over, but they can add additional time. Most of the time the judge will look at your record, and the fine and impound is all they impose. Most of the time you just get a citation when they impound your car - not arrested - unless there are other factors involved (like you are drunk again, possession of drugs/alcohol or have an outstanding warrant for your arrest) However, if you asked for a provisional license and it was denied - the judge can impose harsh penalties for contempt of court. You are now not only violating the original order of suspension - but the judge will be more upset about you ignoring the judgment against your provisional license as well. I can sympathize with your feeling about cops, and your need to now drive, but it is a little hard to accept you saying it is unfair treatment. You are a criminal if you drove drunk- last time I checked that is a crime. How fair would it be to the innocent people you may have harmed ? You do the crime - you do the time !

Being a criminal justice major, I have to say....that the law is the law...and in this circumstance, it should not be broken. You could have killed someone, and now you must live with the consequences. Perhaps you are being treated like a criminal, because technically, you are.

The entire US population is aware that the legal drinking age is 21. You should have thought about the possible outcomes of your decision to drink (and drive), and the problems that it could cause you.

I would not recommend driving any longer. When you are caught, it will go on your record. Employers check records, and most often ask you to list any criminal activity on an application. So it can affect you in more ways then being fined and thrown in the slammer. And, yes, chances are that you would have your license suspended for a longer period.

If you get caught, you don't have a very good chance at getting out of it. Nobody is forcing you to drive. You wake up everyday knowing that you are going to break the law. Therefore, should you have to go to court, you cannot claim necessity, because the mens rea (intent) is there.

And as for the "updated info"....Some of the responses are harsh, and uncalled for. But some, like myself are being honest. You do not HAVE to party...nobody made you do it. It doesn't matter where you live, you still did it. You don't have to be drunk to get a DUI, and any bit of alcohol impares your reaction time. Stop trying to justify your wrong doing. You have to accept the consequences.

Do you know anyone who has been the victim of person who drove drunk? Maimed, disfigured, killed?

That is why you license was suspended you were driving drunk AND under age. Do you realize you could have harmed someone?

Let this be a lesson for you to not drink and drive whether you are under 21 or not.

You may have thought/think your were not drunk, but evidently you also didn't/couldn't pass a sobriety test. Since your license was suspended.

You chose to do something that was wrong something could have hurt other people. Now You have to live with the consequences. It's not the cops fault you did it. It is not the fault of the DMV that you did it. So there is no reason to fault them.

Surely you know someone going to the same college. If not take a bus. Do The Right Thing......

You've got some serious problems. First you are driving a vehicle without a license....that is a criminal offense. Second you are driving a vehicle without a license which means that the vehicle you are driving is not covered with insurance, which is another criminal offense in California. When you get caught driving your license suspension will increase.

Now all the above is known to you so when the police stop you and arrest you and impound your vehicle...don't go bad mouthing the officers who are only doing their job in keeping folk like you off our streets.

Oh....and by the way....you are a criminal.....a DUI is a criminal offense....you committed it therefore....you are a criminal.

Not to be harsh, but you're being treated like a criminal for getting a DUI. You should request a Cinderella license from the court, not the DMV. Let the court know why you need it, and even offer to take some AA meetings, anything to make things right. If you show them you're trying to make things better, they will work with you. In the meantime, don't get into trouble. You're not even 21...it's not worth you losing your license til your 25

Y O U could've hit an innocent child that may have been crossing the street just to get to a home they lived in just on the other side of a road/street !?! Yess it can happen that fast !! " I'll always have & feel some regret!! & I was'nt even driving at this time !! But I was in a car crash back in 1990 !! 2 died that I was in the car with & I ended up in a coma !! the driver of the car I was in lost a leg !! & yes drinking had taken place !! Only I was'nt drinking !! I was just tired but was being taken to a place so I could rest !! In`fact I guess because I was in the passenger seat was the reason that I.. maybe do to the impact of the crash !?! maybe is why I flew out of the front window hitting my head on the phone pole I guess that we ran into!?! Putting me in a coma & 2 others in the car with us did die !! The driver of the car I was in was drunk!!{Lost a leg} it's a long story !! SOo please do'nt ever do that again !! you may die because of it !! even if it's not you driving or even if it's not your fault !! It could be a drunk driver that ends your life!?! Apparently you didn't get the lesson. You were convicted of a crime, billybob, whether you like it or not. Did you appeal? Probably not. So it's time to stop complaining and deal with the situation exactly where you are, since you can't go back.

If you are driving SUPER-RESPONSIBLY now, then you dont really have anything to worry about, do you? But if you are doing the same things you did before... liking risking your a$$ and lives of others by driving under the influence, then you need to really think about if jail time is worth it. You can't tell a judge "well, i had to get to school" -- it's not gonna cut it, as there is no danger to life or property. Sometimes we have to put things off in life until the situation becomes easier. you seem unwilling to consider this, and i don't wish for bad consequences for you, but you see to be asking for them by even refusing to acknowledge your part in this mess.
