Make contact with your local child support agency. They are required under federal law to establish paternity and obtain an order for child support. The service is free or will cost you at a max. $50 per year.

You can file an Order to Show Cause in your local civil courthouse (call the clerk for forms, and there may be an office that can assist you), or you can have the local child support authority file it for you. You have to give information on your financial situation, what you BELIEVE is the financial situation of the other party, and what you BELIEVE is the other party's last known address.

You (or the child support agency) might get a court order (a judgment) but that doesn't mean you'll see a dime. A judgment is simply a legal right to collect, but you get nothing if no assets can be located and the other party doesn't pay voluntarily after a judgment.

Best of luck.

To get an order for child support, you must first file a case with the court in the county, in which you reside. If you do not have an existing case, you will have to file one.

If you are married to the other parent, you can file an action for divorce or legal separation, which will start the process. If you do not want to file for divorce or legal separation, you can file a Petition for Custody and Support of Minor Children.

If you are not married to the other parent, you must file a parentage action. This means you are asking the court to say who the other parent is. This will often include DNA testing, if there is a dispute over parentage. You are also allowed to ask for child support, custody and visitation orders in the same action.

Hope this helps! Best wishes to you.

Hire a divorce attorney. If you can't afford one, apply for Civil Legal Aid. (You must meet income requirements to qualify)
