I'm 25 years old, just recently graduated college. I have been babysitting my girlfriend's friend's daughter who is 12 years old, for about a week now. She is known to be a troublemaker in school but has good grades. Last month while babysitting her, i took away a toy from her for disobeying me, I caught her on phone with friend when she was to be studying. She got upset, cried and ran to her room and slammed the door.
I went up to talk to her, and she was on phone with police, i immediately unlocked door and tried to make her put the phone down. The cops came and she started crying saying i raped her and held her in her room hostage. They charged me with Rape, and Kidnapping, took me to jail, i'm out on bail now. She lied, and filed charges against me! I never touched her. I Hired a lawyer, and there's nothign i can do, except wait till grand jury and, its her word against mine in front of a jury. Even if there is no evidence, from rape kit, i can be convicted!!
how could this happen?

I would think a good lawyer could discombobulate the girl's testimony under oath. She could easily be proven to be a liar with exhaustive cross-examination. Regardless of the cost, I'd hire the best damned lawyer you can find.
What about the girl's mother? Who does she side with? If she's defending her daughter, you need to get out of that relationship (if it hasn't already imploded).
Lie detectors, DNA tests, rape kits, physical examinations could all also add to your defense, as could putting some of her peers on the witness stand who know her to be a 'troublemaker' and a liar. Godspeed! -RKO- 10/20/07

Now why didn't you call your girlfriend's friend and have her take the daughter to the hospital to see if she was really raped? Well, I can go back and ask questions on why you did or didn't do this or that but that's not going to help your situation now. Assuming that what you are saying is true, the only thing you can do is try to see what type of trouble the girl has caused in the past and if she has accused anyone else of rape, kidnapping, or abuse of any type. Also, it would be wise for you to get a really good lawyer who specializes in these types of cases. It is very difficult to clear your name even if you are found innocent. Once you are involved in something like this, people will talk and remember you for the guy who was accused of raping a 12 year old. And of course, stories will get all mixed up over time and make you out to be a monster.
I hope that you are being truthful as I do not know you at all and I really have no sympathy for any sexual predators.

Well. Some girlriend's friend, I say!. Why does a 25 year old have to babysit a 12 year old anyway. Something doesn't sit right. And what's she doing with a "toy"?
Next time youi decide to babysit at 12-year old child, bring along a chastity belt and tell her mother to put the friggen thing on her.

I'm not exactly sure but maybe a lie detector test? You could take one, even she could take one. I'm not sure what the rules are with the results and if you can use them in your case but i figured I could at least mention it. That's really messed up. Rape isn't funny and isn't something that a person should lie about. Hope that helps out a bit and that everything works out ok.

I may be wrong, but without proof from a rape kit, I don't think that that accusation would hold up in court. Unless they waited too late, there would be evidence from a rape kit. Hope it all works out!

Then she wasn't a virgin at 12 or there would have been evidence to that.
Her home, yet charged with kidnapping?
Something is definitely wrong with this picture! Glad you have a lawyer!

The authorities must have some tests (DNA) done, like if you had some physical contact with her (according to the girl), than it can be seen in these tests., there are certain procedures that are going to determine if this happened., obviously one of you is lying, and that is going to be determined as well.
Do you think someone would be convicted based on ones word against the other and that's it??

no! im 13 and i babysit and all i have to do is sit there and watch the kids play with their toys.. and i get paid $15 an hour! ask them for a raise! since you have to do all that work.. you deserve a little more than $5 an hour! good luck! :]

THE ONLY THING I COULD SAY IS MAYBE GUILT WILL GET THE BEST OF HER AND SHE WILL TELL HER PARENTS SHE LIED. I'M SORRY THIS HAPPENED, BUT YOU HAVE ALOT OF FIGHTING TO DO. THIS IS A VERY SERIOUS MATTER.

best thing go to your local news channel and ask them to do a report on how, what tools can someone use, if they have been wrongully implicated.
