I injured my knee badly and called Ask-A-Nurse I explained my injury to the nurse and she said call 9-1-1 and be transported to the hospital because my knee was swollen, cut, hot, painful, looked crooked and I was unable to apply pressure to my leg at all. I told the nurse I will have my fiancee drive me to the hospital and she said ok make sure I go right away. I went in and had X-rays and was examined by the doctor. She said that I had not broke or damged my knee at all and I needed to stay off my leg for a day or two and apply ice and keep the ace bandage on it. She gave me Ibprofen 800 for pain. I am still in a lot of pain and now I have a doctor bill, I already filled an accident report with the store so what do I do now...? Am I able to get money for pain and suffering cause a few people told me I could...? do i get a lawyer or what?

Ask the advice of a lawyer honey. They will give you the advice. Were there any witnesses? Write down everything that happened. Show your doctor bills etc. Continue to ice the knee and go back to the doctor. Take ibuprofen for pain and inflamation. When there is an injury the blood will rush to the area saying I am going to fix it, because it thinks that is its job, however what it does is cause heat and inflamation and so when you put ice on it the blood says man that is cold, sorry about your luck, it leaves the area. Just ask the store to pay for any legitimate medical bills. If they do it would be COURTESY to you. Short of them escorting you in via a gurney, how can they prevent you from falling? Don't further perpetuate this litigious society we live by suing and tying up the courts with frivolous law suits. I assume you are not looking for the "winning lottery ticket?"

The burden of proof is on you to prove that the cause of your fall was to due to gross negligence on the part of the department store.
Did you slip on wet pavement? The department store isn't expected to deploy a team of employees armed with paper towels to dry their parking lot every time it rains.
Just because you happened to fall in their parking lot doesn't mean they owe you anything. But cheer up, with the justice system in this country as screwed up as it is people are constantly being awarded money they don't deserve from frivolous lawsuits.

I think your best chance is to sue your boyfriend for improperly moving you if he was not a doctor. You can also sue your knee for still sending your brain pain signals, but your brain needs to get a restraining order against your knee first and you can sue your feet for lack of support.

just because you fell doesn't mean its the stores fault. you more then likely tripped over your own feet. just be glad you didn't break your knee cap because that hurts for the rest of your life and your laid up for at least 3 months and that is after you have surgery. i know because Ive been through it. forget about suing the store and just walk more carefully next time.

You would have to prove that the company did something wrong -- such as being careless (negligent) in how the parking lot was maintained -- and you would have to sue them in court.
