I spend about 1 year making this software iam selling on my website for a little profit. Someone on ebay bought my Cd and reselling it on ebay for profit without my persmmiton. its a copyrighted software. Who should i contact about this? What should i do? sue them? call the police? search his house for evidence? please advice. william.

If he's selling more then the original contact a lawyer. Ebay Takes care of Ebay. You need someone in your corner.

The first thing that comes to mind is talking to a copyright lawyer. But keep in mind that if the person is not making a lot of money from your software you will probably spend more than you will ever recover.

So first, I would just contact e-bay and explain the problem and that they have them shut down the person if they don't want to be sued by you. They are way more interesting to sue than the seller since they have more money. Believe me this person will be gone very quickly.

Anymore than that and you would be better off with a lawyer. And do NOT search his house. You are not the police.

I'm not sure it's copyright enfringement. That would meant that he took your idea and made another program exactly the same as your or very similar and then sold it on CDs, or he copied your software on multiple CDs and sold them. I don't think there is anything wrong with buying an original CD on Ebay and reselling that same original CD. People buy and resell on Ebay all the time.

First off you should contact eBay to let them know that the seller has violated copyright laws. (This is assuming he is making copies of your work and is now selling them for profit)
They tend to have strict policies about that sort of stuff and will remove the auction.
As stated already, purchasing something then later reselling that for more is not against the law. If it were eBay would not even be in business.


As far as pursuing him legally I would consult a lawyer about this and supply them the proof that your claims are legitimate and they should be able to let you know from there.

If they sold the copy they bought from you (assuming they bought it on a cd in the 1st place, and they sold the original cd), it isn't copyright infringement. However, if they have made copies of that cd and are selling them, then contact ebay with COPYRIGHT INFRINGEMENT as your topic, they will contact you, ban the user and/or press legal charges.

Find out who they are and write them a letter . If you still get no results , find a reputable attorney and give him a smack !
