Any two wheeled vehicle with an engine is a motorcycle by definition. Just because one may be classed as a moped for licencing regulations does not make it any less of being a motorcycle.

Trust me on this one. A moped ( presuming its newer than 1977) is two wheeled machine , 50cc or less engine capacity AND having design speed of 30 mph or less.Anything other than than all of the above is a motorcycle.If its pre '77, its less than 50cc with ability to be seperately propelled by pedals.ie old FSIE's.Speed didn't come into it then.So if you have a 49cc machine from say 1990 that's been 'played' with and will do 45mph, or a big bore kit fitted taking it out to 65cc,it's a motorcycle.

champ did a rs 50cc model with 4 gears it was a really nice bike for a beginner based on the Honda 50cc engine but with a proper clutch on the handle bars

In the U.K. the legal definition of a moped is, "Any motorised two wheeled vehicle, with an engine capacity NOT EXCEEDING 50cc and a maximum design speed not exceeding 50km/h." (VOSA).

So if it's less than 50cc it's a moped. If it's more than 50cc, it isn't. Simple, really!

If it has gears and a throttle then it is a motorcycle (a cycle with a motor) mopeds are single geared automatic clutch. but the law sees any 50cc vehicle as a moped.

It's determined by it's chassis configuration.

Years ago, I bought a Yamaha DT50 street and trail as a daily commuter. I went to get insurance, the company asked what cc is my engine, I said 49cc, and they said "well that considered a moped, that will be $38 for the year please" Thanks small engined motorbikes :) Now, thats here in Canada so your region may be different.
