On 8/28/07, I decided to purchase a Hunter Garage fan from Lowe's. Normally selling for 159.99, it was on sale online for 88.90. It wasn't available for purchase in store or online but was for special order. So I went into the store, placed the order and paid for it. 10 days later, I call to check on the status. They tell me it was never ordered. So I ask them to place the order again. 10 days later, I come into the store. They say its on "permanent buy back" meaning Hunter was buying all the fans back from Lowe's. They tell me the only option is to refund my money because they can't order anymore. But I paid for it before the buyback. Its now been 2 months since the initial order and they have called Hunter directly to order it that way rather than through Lowe's. They said to allow 24 hours to fax, and 2 weeks to get the fan. Its been nearly 3 weeks. What other actions can I take to get this resolved? I know there's a legal term for offering at one price, and not providing it. Help!

I've been in contact them constantly and they are failing to return my phone calls. Its not possible to contact Hunter directly. The term I'm thinking of is similar to bait-and-switch but they never offered a subsitute product. I continue to get the "there's nothing we can do" excuse and no one seems interested in helping me. My next plan is contacting the BBB or the attorney general b/c they have had 96.23 of my money for 2 weeks. Money I could have invested elsewhere. I hate to take legal action, but by not providing the product I purchased, aren't they technically breaking business law? What else should I do from here?

What this really boils down to it principle. I ordered the fan before the buyback. I want that fan and will accept nothing else but that fan. I technically could buy it elsewhere for $200 or on eBay for around $150 but I bought it from Lowe's for 88.90, and I WILL get it from Lowe's!

I don't want the refund.

contact the corporate office and talk to someone in real authority ...this is not ok at any level and may be taken up the ladder all the way...if you want to know what is going on here...and no one is willing to take responsibility then this is the best that can be done...but I would call the store and talk to the manager to ask for the corporate number ....they have to give it and inform that the complaint and the ability to circumvent the next step is his, if he will offer nothing new then call the corporate headquarters and follow through on this complaint

Well you are allot like me ,, I want what I paid for ,
Ok try this call up a couple of other Lowes stores and see if maybe one of them has it in stock,, I dont mean their 800 number, You just might get lucky ?
NOW if that does not work ,, And its about principle take them to small claims court , Yea its allot of trouble,, BUT, You can voice your problem and since you did nothing wrong , You should win,, But its a hassle to do it , but to me it would not be, only because I hate business that don't take of their costumers frist,,
Or I would call HUNTER up and complain to them about how LOWES has treated you and that they are not taking care of their products and costumers that are being sent to Lowes,,
Or write a letter to the editor of your local newpaper, and get it in print and send them a copy of it ,, ha ha they hate bad publicity , or Make a sign and walk up and down their store
They will hate that to ..
Or do what the other guy said just ask for your refund at the highest price, period,, or pick out another fan and ask them to sell it to you for the same price or your going to take them to court , and call the BBB , and the Chamber of commerce in the city ,
Dont let them win ,, just keep trying , Don't lose sleep over it , And Good Luck ,,

Take your receipt to Lowes and get a refund by cancelling the order. If they refuse ask for the manager.

I faced a similar situation here in Geneva and I went to the Police and everywhere I can but after a week I decided to accept what they will offer to me because it is the easiest solution do not disturb yourself!!!!!!!!!!!!! I feel sorry for you and for myself!!!!!!!!

They don't have the product you wanted anymore. Get your money back and move on.
