i gave a womsn $1350.00 for a deposit on a house that i never moved into. she didnt show at court so i won by defult. she wont answer my calls or letters. theres some one eles living in the house .i served this family with garnish paper for the rent . they refuse to pay me and the court said it was nothing they could do about it. i really want my money back.

The garnishment should have worked. Perhaps you did not do it properly? If the tenant refuses to pay you the money that they owe to your debtor, then the court should give you a judgement as against the tenant.

Another possibility... You gave the woman a check for the $1350? If so, take a look at your cancelled check. See where it was deposited, then garnish her bank.

Is the women employed? If so, garnish her employer.

Winning a claim is only half the battle (as you now know). Collecting takes more energy. Since it appears she is renting the house out (property she owns), file a lien on the house.

file a motion for execution of judgment before the court which rendered the decision, then stipulate for an interest plus the collection expenses. then if you want to be meaner ask the court to cite them for contempt. an execution of judgment may be effected upon her movable or immovable properties. why didnt you charged her of estafa or misappropriation? so that in such way she will go to jail!

you must some how find the original person you gave the monies to then go after them, maybe try a private eye to locate the person

but who ever is living in the home now has nothing to do with collecting your monies owed

Wining is quiet different from collecting.

See a lawyer but you may never see the money.

Consider a cheap lesson.
