My employer has occasional mood swings and isn't easily approachable. Myself and other staff agree that she is imtimidating. We often work 10-12 hour shifts with no breaks and i believe that it is of her opinion that the staff will take no action, due the young age and naivity of the workforce.
Today after a ten hour shift i was told i could finish by the assistant manager, yet upon leaving the person in question challenged me on why i was leaving. I explained that the assistant manager had let me finish, and that i didn't realise i should have asked her permisson, to which she replied "stop being a sarcastic tw*t" This was in front of an audience of other employees and not only did she insult me she also undermined and embarassed the assistnant manager. similar Incidents have happened like this on other occasions and I am starting to wonder how to take legal action against this control freak of a boss? PLEASE HELP

Quit and seek legal advice,trust me...
This will come under "Constructive Dissmisal"
I take it you are in the U.K(if so go to the Citizens Advice Beureau)
This will soon bring her down a peg or ten.
And you are also legally allowed breaks working them sort of hours.
Good luck and give her what for.

How horrible for you all. It is illegal to work 4 hours without a break.....she sounds intimidating and abusive.
Does she have a Manager above her, if she does then you need to speak to them. You need to check your own complaints precedure it should tell you about what you need to do to follow Staff procedures. I dont suppose you are in a Union, but if you are then go to them. If you are not why dont you get the rest of the staff to join one with you.
The Citezans Advice Burea can give you free information and you will find them in the Yellow Pages.
She has no right to call you names and bully you this is against the law and you all need to file a complaint in writing.
The first step would be her line Manager and then take it from there. I hope this helps.....Good Luck.

Well is there anyone within the workplace you can complain to. If so , then make your complaint official and then use all those people who witnessed the verbal assault as people to back up your complaint.

If you have no union in your workplace, then speak to the Citizens Advice bearau, to see which way to handle your complaint.

Also regarding your breaks, this is ilegal. You should demand breaks you should have at least 2 20mins breaks for that length of shifts.

If they fail to breaks and they discipline you, then you could take a case of constructive dismissal to an Industrial Tribunal.

yes you do have a case for bullying!. i worked in a place and the manager was the same (bad attitude, using bad language towards the staff and name calling). the manager used to call a girl 'hyacinth bouquet' over the intercom and said she had no sence of humour...she took action against the manager and the manager was sacked!

another case was when the assistant manager swore at employees and called them names but she just had to apologise to the employees.

you need to think of how severe your case is and you need to contact the right people. contact a union representative and explain your story...theres no harm finding out where you stand anyway, thats what the unions are there for!

From "Your guide to the Working Time Regulations"

"If a worker is required to work for more than six hours at a stretch, he or she is entitled to a rest break of 20 minutes.

The break should be taken during the six-hour period and not at the beginning or end of it. The exact time the breaks are taken is up to the employer to decide.

Employers must make sure that workers can take their rest."

Do you have a union rep, as you do have a valid case here, your boss is a power freak, & you are working far to many hour's, if your not part of a union then you need to become part of one, & it would help if your co-workers backed you up. good luck don't let it let you down, if it starts doing that, may i recommend you look for another job, hand in your notice, when you've got one, then tell this power freak in front of everyone just what you, think of them, & ask if they know slave labour has been abolished, good luck.

You have a VERY valid bullying case on your hands. She is also breaking employment law as you are entitled to a break in your 4th hour of a shift and every 4th hour after that I believe. Take her to town , she's taking the piss the vindictive *****!!!!! Are you in a union, speak to them about it.

You need to make a formal complaint (in writing) to her boss. If you don't want it to be formal then just approach her boss in confidence.

If you are serious about legal action, you need to have approached top management with your complaint first. Unless you have a union in which case take the complaint to them and let them deal with it on your behalf.

You don't have a bullying case, but you do have a violation of mandatory breaks case.
